Abstract

From a critical and analytical standpoint, based on the norms established by the Spanish Constitution of 1978, this article examines the manner in which Spanish law assumes the criminal protection of the State’s patrimony interests, after the Criminal Code of 1995 was drafted. the purpose of this work is to determine the positive and negative aspects of said legislative proposal, as a referent to assess the manner in which the national law assumes the protection of those interests and as a parameter to examine a possible reform initiative of this sector of the legal system.
